SIT Declares Lakhimpur Kheri Incident as ‘Pre-Planned’; asks court to add-on Charges

New Delhi: The Special Investigation Team (SIT) that was investigating the Lakhimpur Kheri violence has urged the chief judicial magistrate to replace lesser charges in the case like causing death by negligence with an attempt to murder as the incident was a “pre-planned conspiracy causing death”.
The SIT has urged to remove IPC sections 279 (rash driving/riding), 338 (causing grievous injuries by negligence) and 304A (causing death by a rash and negligent act) and Induct IPC section 307 (attempt to murder) among others in the case related to the 3rd October violence.
The UP government formed a nine-member SIT to investigate both cases. But The SIT was later reconstituted by the Supreme Court for an Independent Probe.
The Investigators at that time identified and arrested 13 people in FIR related to the matter, including Ashish Mishra (son of Ajay Mishra), Sumit Jaiswal, Ankit Das. Another FIR was filed leading to the arrest of 4 more people. All the accused are in judicial custody.
